1. Return Eligibility:
Non-Returnable Items: All projector equipment, lenses, accessories, and service plans sold by Proven Projectors LLC are final sale and are non-returnable unless the product is found to be defective or damaged upon receipt.
Defective or Damaged Products: Customers must notify Proven Projectors LLC within 7 days of receiving defective or damaged products. If the product is deemed defective, Proven Projectors LLC will arrange for a replacement or repair at its discretion.
2. Return Process for Eligible Products:
For items that qualify for return, the customer must obtain a Return Merchandise Authorization (RMA) by contacting Proven Projectors LLC. Returned items must be shipped back in original packaging and include all accessories and documentation. Returns without an RMA will not be accepted.
Returns must be shipped back to Proven Projectors LLC at the customer’s expense within 7 business days of receiving the RMA.
3. Delivery Confirmation:
Upon delivery of the product, the customer (end user) must confirm receipt within 2 business days by contacting Proven Projectors LLC at orders@provenprojectors.com.
If the customer fails to confirm delivery within 2 business days of receipt, Proven Projectors LLC reserves the right to automatically confirm delivery on behalf of the customer. This automatic confirmation is legally binding and serves as proof of delivery, thereby releasing payment from First Citizens Bank or any other financing institution.
4. Failure to Confirm Delivery:
Automatic Confirmation: If no confirmation is received from the customer within 2 business days, Proven Projectors LLC will automatically confirm the delivery and assume the customer’s acceptance of the goods. By agreeing to this policy, the customer acknowledges that this confirmation is final and binding, and Proven Projectors LLC will proceed with notifying the relevant financial institutions to release payment.
5. Restocking Fees:
For any items accepted for return, Proven Projectors LLC may charge a restocking fee of up to 15% of the original purchase price, unless the product is defective or damaged in shipping.
6. Assumption of Liability:
After the 2-Day Delivery Confirmation Period: Once the 2-day confirmation period has passed (either through customer confirmation or automatic confirmation by Proven Projectors LLC), the customer assumes all responsibility for the product. Any claims of non-receipt or disputes over the condition of the product will no longer be accepted.
Reporting Defects: Any issues related to defective or damaged goods must be reported within 7 business days of delivery. Failure to report issues within this timeframe absolves Proven Projectors LLC of any responsibility for repairs, replacements, or refunds.
7. Dispute Resolution and Legal Jurisdiction:
Any disputes arising from this Return Policy will be subject to binding arbitration in the jurisdiction of Washington State, with each party responsible for their own legal fees.
This Return Policy is governed by the laws of the State of Washington State, and by purchasing from Proven Projectors LLC, the customer agrees to be bound by the terms outlined in this policy.
8. Binding Agreement:
By purchasing from Proven Projectors LLC, the customer acknowledges and agrees to this Return Policy. The customer understands that failure to confirm delivery within the required timeframe will result in automatic confirmation, which is legally binding.
